Notice of Privacy Practices

Our commitment to your privacy

CallMD Now is required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) to maintain the privacy of your protected health information (PHI), provide this Notice of our legal duties and privacy practices regarding your PHI, follow the terms of the Notice currently in effect, and notify you of any breaches affecting your unsecured PHI.

How we may use and disclose your health information

For treatment

We use your PHI to provide medical care. Your CallMD Now clinicians access your records. We may share information with other healthcare providers involved in your care (specialists we refer you to, your existing primary care provider, the hospital if you're admitted).

For payment

We share PHI with your health plan to verify your eligibility, obtain prior authorizations, and submit claims for payment. We may also share information with you about what you may owe.

For healthcare operations

We use PHI to operate our practice — to assess and improve the quality of care, train staff, conduct clinical audits, manage our business, and develop policies. We may share de-identified information for research, quality measurement, and public health.

Other allowed uses

• Required by law — When state, federal, or local law requires disclosure (e.g., reporting child abuse, communicable diseases, gunshot wounds).
• Public health activities — Reporting to NY State Department of Health for disease surveillance and prevention.
• Health oversight — Disclosures to government agencies for audits, investigations, and licensing.
• Judicial proceedings — In response to a court order, subpoena, or other legal process.
• Law enforcement — In specific circumstances permitted by law.
• Coroners, funeral directors, organ procurement — When applicable.
• Workers' compensation — When relevant to a workers' comp claim.
• Emergencies — To prevent serious harm to you or others.

Uses requiring your written authorization

The following uses require your specific written authorization (which you can revoke at any time):

• Marketing communications (we don't currently market to patients)
• Selling your information (we will never do this)
• Most uses of psychotherapy notes
• Disclosures of substance use treatment information beyond what's required for treatment

Your rights regarding your health information

You have the right to:

• See and copy your records — Within 30 days of request. Electronic copies provided when requested.
• Request corrections — If you believe information in your record is incorrect.
• Get a list of disclosures — Of when we've shared your PHI (with some exclusions).
• Request restrictions — On how we use or share your PHI (we are not required to agree, except for specific cases involving payment with out-of-pocket funds).
• Request confidential communications — Specifying how or where we contact you.
• Receive a paper copy of this Notice — Even if you've agreed to receive it electronically.
• File a complaint — With us or with the U.S. Department of Health and Human Services if you believe your privacy rights have been violated. We will not retaliate against you for filing a complaint.

NY State protections (in addition to HIPAA)

New York State law provides additional privacy protections, especially for:

• HIV/AIDS-related information
• Mental health information
• Substance use disorder treatment
• Genetic information
• Reproductive health (including abortion and contraception)
• Adolescent care (ages 12+)

We follow these additional NY State requirements strictly.

Changes to this Notice

We reserve the right to change this Notice at any time. Changes apply to all information we maintain, including information collected before the change. The current Notice is always available on our website and upon request.
