These Terms of Service ("Terms") govern your use of CallMD Now's website and services. By using our services, you agree to these Terms.
CallMD Now is a telehealth medical practice incorporated in New York State. We are licensed to provide medical care to patients physically located in New York State.
You must be 18+ to use our services on your own behalf. Minors may use our services with parent/guardian consent. You must be physically located in New York State at the time of each visit. You must provide accurate information when registering.
Telehealth medical care including but not limited to: primary care, urgent care, mental health (therapy and psychiatry), chronic condition management, dermatology, nutrition, sleep medicine, sexual health, tobacco cessation, and weight management. Services are provided by NY-licensed clinicians.
Telehealth has limitations. Some care requires in-person evaluation. Emergencies require 911 or the nearest emergency room. Severe mental health crises require 988 or 911. Our clinicians use professional judgment to determine when telehealth is appropriate; we will refer you to in-person care when needed.
A provider-patient relationship is established when you complete an initial visit. Before that, our website and intake forms do not constitute medical advice.
You agree to pay any amounts owed for services. For insured patients, we verify coverage and submit claims; you remain responsible for copays, coinsurance, deductibles, and any services your plan denies. Self-pay rates are published on our Pricing page.
You can cancel any appointment at no charge up to 1 hour before the scheduled time. No-shows (failing to attend without canceling) may incur a $25 fee for self-pay patients. We don't charge fees for Medicaid no-shows but ask that you call us if plans change.
Our clinicians prescribe medications based on clinical judgment and NY State law. We follow NY State telehealth prescribing rules, including specific restrictions on controlled substances. We don't guarantee any particular prescription will be issued — that's a clinical decision made by your provider.
By providing your phone and email, you agree to receive appointment-related communications including reminders. You can opt out of non-essential communications anytime. Standard text/data rates may apply.
All content on our website (text, images, logos, design) is owned by CallMD Now or our licensors. You may not reproduce, distribute, or create derivative works without permission. Patient-facing educational materials may be saved and shared for personal use.
Our services are provided "as is." We don't guarantee specific clinical outcomes. The information on our website is for general informational purposes and does not constitute medical advice for any individual.
To the maximum extent permitted by law, our liability is limited to the amount you paid for services in the 12 months before the claim. We are not liable for indirect, consequential, or punitive damages. This doesn't limit liability for clinical negligence; our malpractice insurance handles those claims separately.
You agree to indemnify CallMD Now against claims arising from your misuse of our services or your violation of these Terms.
These Terms are governed by New York State law. Disputes will be resolved in state or federal courts in New York County, NY. You may also have rights under federal HIPAA enforcement.
We may update these Terms. Material changes will be posted with the updated date. Continued use means acceptance.
